Independent school registration
The DfE registers independent schools in England, with Ofsted involved in pre-registration assessment and subsequent inspection as applicable. Schools that require registration must not operate before approval.
DfE application & checklistEarly years registration & EYFS
Most providers caring for children under eight need relevant registration unless an exemption applies. Early years services must also meet their applicable statutory EYFS requirements.

The answers depend on the setting’s precise operating model. These questions can help you identify what to check before taking the next step.
Ask about your provisionDoes every SEN or specialist education setting need Ofsted registration?
No. SEN or specialist provision is not, by itself, a single registration category. The correct route depends on the education model, pupil numbers and characteristics, provision type and applicable law. An independent school may need DfE registration and Ofsted inspection; other services follow different rules.
Who registers an independent school, DfE or Ofsted?
The Department for Education maintains the independent school registration process in England. Ofsted may undertake a pre-registration inspection and subsequent regulatory inspections. A school that requires registration must be registered before it operates.
Does every alternative provision provider need to register?
Not automatically. The requirements depend on the education delivered, whether it amounts to full-time provision, the pupils involved and the operating model. Some alternative provision may meet the legal definition of an independent school. Seek a provision-specific assessment before opening.
Do holiday clubs or wraparound care providers need Ofsted registration?
It depends on the children’s ages, hours, activities, premises and any specific exemptions. Some provision must register, some can register voluntarily and some is exempt. Check Ofsted’s current childcare registration exemptions rather than relying on the name of the club.
Can Delphi help with a new nursery’s staffing and safeguarding?
Yes. Within the agreed scope, Delphi can discuss staffing plans, safer recruitment, safeguarding procedures, governance and readiness against the applicable EYFS requirements. Age-specific ratios and qualification rules should be checked against the current statutory framework for that setting.
Can you prepare an independent school for Ofsted inspection?
Delphi can discuss independent readiness support suited to the applicable inspection requirements and available specialist expertise. Mock reviews do not replace official inspections, and no inspection outcome or registration approval is guaranteed.
Can you support existing education providers, not just new start-ups?
Yes. The original Delphi service includes providers expanding or improving existing education and specialist provision. Work can focus on safeguarding, governance, documentation, leadership or inspection readiness.
Which safeguarding guidance applies to my setting?
Schools and colleges should use the current Keeping Children Safe in Education guidance; early years providers follow the applicable EYFS safeguarding requirements. Out-of-school settings should check the relevant DfE safeguarding guidance and any other duties arising from their operation.
What should I include in my initial enquiry?
Share the type of provision, location, children’s age ranges, proposed operating hours, registration status, current priorities and intended launch date. Please do not include identifiable information about children or confidential safeguarding records in the general enquiry.
